Article 1 - Preamble

Any order of a product listed in the online store of the website www.skineance.com implies full and unreserved acceptance of these General Terms and Conditions of Sale. Consequently, the customer acknowledges being fully informed that their agreement regarding the content of these General Terms and Conditions of Sale does not require the manual signature of this document, to the extent that the customer wishes to order online the products presented on the eshop www.skineance.com.

Article 2 - General Conditions

2.1. - Generalities
The Customer has the option to save or print these General Terms and Conditions of Sale, it being specified that both saving and printing this document are their sole responsibility. Intersourcing may modify these General Terms and Conditions of Sale at any time, provided these modifications appear on its website. Nevertheless, ongoing contracts remain subject to the conditions applicable at the time of the conclusion of the sale. You are therefore advised to regularly refer to the latest version of the General Terms and Conditions of Sale permanently available on the site.

2.2. - Definitions
"Customer" means any physically capable person, legally capable, who acquires or uses, for purely non-professional purposes, products or services presented on the website. The customer therefore has specific rights, which would be questioned if the products or services acquired through the website were actually related to their professional activity.

Article 3 – Generalities, Invoicing and Customer Contact Details

3.1. - Generalities
The product catalog and its description on www.skineance.com do not constitute an offer as such. It is therefore not enough to fill out an order form on the aforementioned site for the sales contract to be formed. The sale will only be definitively concluded upon receipt of the confirmation email.
For the customer's security and certainty, Intersourcing reserves the right to request additional information and to refuse the execution of the order in the absence of an adequate response or if Intersourcing considers the information in its possession to be insufficient. Intersourcing may also refuse orders when it appears that the buyer intends to resell the products.

3.2. - Invoicing
Each order will be subject to an invoice. The invoice is attached to each package and is also available upon request from Customer Service. Please mention the following information with your request: Last Name, First Name, Order Number, billing address.

3.3. - Customer Contact Details
All information provided by the customer when entering the data related to their order is binding on the customer. Intersourcing sa can in no case be held responsible for errors made by the customer in the wording of the recipient's details (delivery address, billing address, email address, last name, first name) and for delivery delays or the impossibility of delivering the ordered products that these errors could cause.

Article 4 - Order Confirmation

The contractual information will be confirmed by email within 24 hours following the order. If this is not the case, please contact Customer Service.

Article 5 - Purchase

Intersourcing will respond to your order within the limits of available stock. Almost all products are in stock. If the ordered product is not or no longer immediately available, Intersourcing informs the customer of the delivery time by email or telephone. If the given deadline does not satisfy the customer, they can then choose to modify or cancel their order and a refund will be applied depending on the customer's decision.
Shipping times are given for information purposes only. Nevertheless, if despite its vigilance the products prove to be unavailable after your order, Intersourcing will inform you by email and invite you to cancel or modify your order.
The photos on the site are non-contractual. It is possible that the packaging of the delivered product differs slightly from the photo of the product presented on the site.

Article 6 – Price and Promotions

6.1. - Product Prices
The prices of our products are indicated in EURO, all taxes included, excluding shipping costs. Shipping and delivery costs are the responsibility of the customer (unless special conditions are indicated on the site). They are displayed, taking into account the information provided by the customer regarding the place of delivery. Intersourcing reserves the right to modify its prices at any time. However, Intersourcing undertakes to apply the prices in force that were indicated to you at the time of your order.

6.2. - Promotions
The promotions and discounts offered on www.skineance.com are not cumulative. They are valid only on our online store. Discounts are not valid retroactively. Discounts are not cumulative with other promotions, discounts and/or marked down items. Discounts are not exchangeable for cash. Intersourcing reserves the right to modify the conditions of the promotion or interrupt it before term at any time.

Article 7 – Payment

Payment of the total price must be made at the time of your order. Under no circumstances can the sums paid be considered as deposits or down payments. All orders are payable in EURO. To pay for your order, you have the following payment methods: credit card or bank card, PayPal or bank transfer.
In the latter case, the products are reserved for the customer for 5 working days from the order, pending payment. Once this period has passed, we may decide to cancel the order.
You guarantee Intersourcing that you have all the necessary authorizations to use the payment method chosen when registering the order form. Intersourcing reserves the right to suspend or cancel any order and/or delivery, whatever its nature and stage of execution, in the event of non-payment (or payment incident) of any sum that may be due. The delivery of any new order may be suspended in the event of late payment of a previous order and this, notwithstanding the provisions hereof. Intersourcing reserves the right to request a photocopy of your identity card and/or bank statement for any payment by bank card.

Article 8 – Delivery and Return

8.1. - Generalities
The products purchased on www.skineance.com are only delivered to the countries indicated on the site. They will be delivered to the address indicated on the order form within thirty days of the conclusion of the contract. The deadlines indicated on the product sheet are indicative and correspond to the processing and shipping times plus the delivery time.
Intersourcing cannot be held responsible for the consequences due to a delay in delivery related to the responsibility of the postal service or any other means of delivery. There will be no refund of the order until it is returned to the sender.
If you decide to cancel your order after payment and your order has already left for delivery, Intersourcing will only refund this product upon its complete receipt and provided it remains in its original condition. Transport and return costs are the responsibility of the customer.
Free delivery from 50€ of purchase is valid only for deliveries to European countries. It is at the full price outside European countries.

8.2. - Customs Duties
Any reservation about the delivered product (for example: damaged package, already opened...) must be notified to Intersourcing within 3 days following receipt of the product. Depending on the case, you may or may not benefit from the exchange and refund conditions provided for in this article.
Any problem concerning the items contained in the package (expired item, missing item, item not matching the ordered item...) must be notified to Intersourcing within 7 days following receipt of the package. Any notification after this deadline will no longer engage the responsibility of Intersourcing and will therefore be neither refunded nor replaced.

8.3. - Delivery Problems
When you order products to be delivered to a country other than Belgium, you are considered the approved importer and must therefore comply with the laws and regulations in force in the country where you receive the goods. You may be subject to import duties or taxes upon arrival of the goods in your country. All additional customs clearance costs are your responsibility. Intersourcing has no control over these costs and does not know their amount. Since customs policies vary from country to country, you should contact your local customs service for more information.

8.4. - Product Conformity
Intersourcing undertakes to refund or exchange products that are apparently defective from manufacture or do not correspond to your order. In this case, we thank you for detailing this in writing and for returning the product(s) to Intersourcing. Intersourcing will proceed, according to your choice, to the exchange or refund of the product(s). The request must be made within seven working days following delivery. Any complaint made outside this period cannot be accepted.
The products must be returned to Intersourcing in the condition in which you received them with all the elements delivered (accessories, packaging, instructions...). The costs incurred by this return will be reimbursed to you on the basis of the invoiced rate.

8.5. - Package Return
IMPORTANT: if the customer is not present at the time of delivery and does not collect their package from the post office within 15 days, the package is returned to Intersourcing. In this case, Intersourcing will only resend the package to the customer when this package has been received back (or reimbursed by the post office in the event of loss), and the shipping costs for this second shipment will be requested from the customer, even if it turns out that the post office did not leave a notice of passage.

Article 9 – Warranty

9.1. - Invoice
The invoice, delivered with the ordered item, serves as a guarantee and must imperatively be attached in case of return of the item.

9.2. - Exchange or Refund
Exchange or Refund: We provide a warranty for any defect or material defect whatsoever, but this is strictly limited to the repair or exchange or refund of the item and only to the extent that the defect or vice has been reported to us in writing within 7 days following receipt of the item.

9.3. - Force Majeure
Force Majeure: Apart from the risk of destruction or degradation occurring during the transport of the products, we do not provide any guarantee for incidents due to fortuitous events or force majeure, as well as for repairs resulting from normal wear and tear of the item, or for deteriorations resulting from negligence, or abnormal use, as well as for any modification made to the item.

Article 10 – Satisfaction or Refund

10.1. - Conditions
In accordance with the legislation in force for distance selling (Title VI of the Economic Law Code), the customer benefits from the right to waive their purchase, without penalties and without giving any reason. The customer has a period of 14 calendar days from the receipt of the ordered products to return them to Intersourcing for exchange or refund.
The products must imperatively be returned to Intersourcing in perfect resalable condition, in their original state (packaging, accessories, instructions), duly sealed, as well as a copy of the invoice or delivery note within 14 days. Any incomplete, damaged, deteriorated product or one whose original packaging has been damaged will not be refunded or exchanged.
IMPORTANT: The costs of returning the goods are the responsibility of the customer. The shipping costs that Intersourcing incurred for your order will in no case be reimbursed.
Within 14 days after notification of the exercise of the right of withdrawal by the customer, Intersourcing will refund the sums paid, including delivery costs. Nevertheless, Intersourcing will only refund standard delivery costs and not additional costs incurred by the customer's choice of another mode of delivery.
Intersourcing may defer reimbursement until the goods are recovered or until the customer has provided proof of shipment of the goods. The reimbursement will take place by the same means of payment as that used by the customer unless the latter agrees to another means of reimbursement.
Attention: PRODUCTS ON SALE ARE AN EXCEPTION TO THIS LAW, consequently they will never be taken back or exchanged!

10.2. - Customer Data
The information you provide to us as part of your order is used exclusively by the company INTERSOURCING SA, for the purpose of allowing contact with customers interested in the products and services provided by our company. In accordance with the law of December 8, 1992 relating to the protection of personal data (as amended several times), you have the right to consult this data, the right to rectify it in the event of error or modification, as well as the right to object, at any time, upon request and free of charge, to its processing.

Article 11 – Limitation of Liability

Without limiting the scope of these General Terms and Conditions of Sale, no claim whatsoever concerning delivered products, non-delivery of products or otherwise may exceed the amount of the purchase price of the products that gave rise to a claim for damages. In no case can Intersourcing be held liable for indirect, incidental, or consequential damages of any kind whatsoever, arising in connection with its products, their use, their sale, or the website.

Article 12 – Disclaimer Regarding Our Products

The information on this website has been collected and checked with the greatest care. Nevertheless, we decline all responsibility for its topicality, accuracy, completeness, and/or quality. The results obtained during efficacy studies, customer testimonials, or any other information stating the performance of our products are given for information only. We draw your attention to the fact that the results obtained may vary from individual to individual.
This website is a source of general information and can in no case be considered a substitute for medical or specialized advice. In the latter case, please consult a doctor or specialist.
The risk of loss or damage to the delivered good is transferred to the customer as soon as the customer has taken physical possession of the good.
In the event of delay, Intersourcing will fulfill its obligations as quickly as possible and reserves the right to distribute the remaining product stocks among its customers fairly.

Article 13 - Force Majeure

Intersourcing sa assumes the risk and cost of deterioration or loss of the goods until the consumer receives the products. In the event of late delivery, Intersourcing sa will fulfill its obligations as quickly as possible and reserves the right to distribute the remaining products among its customers fairly.

Article 14 – Data Protection

By placing your order, you agree that Intersourcing sa may store, process, and use the data collected from your order form. Some of this information may be transferred to the companies involved in the delivery of your products. The content of the Intersourcing sa site may not be copied. It may not be modified, placed on another site, or published in any form without the prior written authorization of Intersourcing sa.

The contract is governed by Belgian law. The French-speaking courts of Brussels are the only ones competent to hear disputes arising from this contract.
